Terms of Use (TOU) – MAALMIYA.MA

These Terms of Use govern access to and use of the Maalmiya.ma platform (hereinafter 'the Platform'), operated by Maalmiya.

The Platform connects individuals ('Clients') seeking construction and renovation services with professionals ('Providers'), whether registered ('Business') or unregistered ('Basic').

Using the Platform implies full acceptance of these TOU.

Clients must provide accurate information upon registration and agree to use the Platform lawfully.

Providers may register as either Basic (individual) or Business (legal entity). They are responsible for compliance with laws, regulations, and tax obligations.

Maalmiya does not guarantee the quality or completion of services offered by Providers.

The Platform is intended for adult users only.

Users agree not to misuse the Platform, publish illegal or defamatory content, or disrupt its operation (e.g., spam or hacking).

Maalmiya reserves the right to suspend or delete any account in case of TOU violations.

Users may post reviews, photos, or descriptions. They must ensure that all content complies with applicable laws and does not infringe on third-party rights.

By posting, users grant Maalmiya a non-exclusive, free, transferable, worldwide license to use and distribute their content as part of the Platform.

All site elements (texts, graphics, code, databases, logos) are Maalmiya’s exclusive property, protected by intellectual property laws.

Unauthorized reproduction or use is strictly prohibited.

Maalmiya collects and processes user data in accordance with Moroccan Law 09-08 and international standards.

Data is used for account management, user connection, billing, and improving services.

Users can access, modify, or delete their data by contacting claim@maalmiya.ma.

Prices and payment methods are available on the Platform and may change with prior notice.

Payments are processed securely via authorized providers.

Refunds are only issued in case of errors attributable to Maalmiya.

Maalmiya acts solely as an intermediary and is not a party to contracts between Clients and Providers.

Maalmiya cannot be held liable for service quality, delays, disputes, or damages resulting from Platform use.

Maalmiya may suspend or delete accounts in case of violations, fraud, or abuse.

Users may close their account at any time via their personal dashboard.

Maalmiya may modify these TOU at any time. Users will be notified by email or platform message.

Continued use after modification constitutes acceptance of the new TOU.

It is strictly prohibited to extract, reproduce, or reuse data from the Platform for competing purposes.

Any violation may result in immediate account termination and legal action.

Users agree to communicate respectfully and avoid defamatory or discriminatory behavior.

Fraudulent or abusive conduct may result in account suspension or deletion.

Maalmiya shall not be held responsible for non-performance caused by force majeure, including natural disasters, cyberattacks, strikes, or government decisions.

These TOU are governed by Moroccan law.

Any dispute will be submitted to the competent courts of Tangier.
